These terms apply to your use of carpenteradelaide.com.au (the “website”) and the Carpenter Adelaide referral service (the “service”), which are operated by Searchology Pty Ltd (“Searchology”, “we”, “us”, “our”). By using the website or submitting an enquiry, you agree to these terms. If you don’t agree, please don’t use the website or the service.
What we do
Carpenter Adelaide is a free referral service. When you submit an enquiry, we pass your details to one or more independent carpenters so they can contact you about your project. We don’t design, build, install, repair, inspect or supervise any carpentry or other building work.
Carpenters are independent businesses
Carpenters we refer are independent businesses. They aren’t our employees, agents, contractors or partners, and they don’t act on our behalf.
When we describe a carpenter as “recommended”, we mean they met our referral criteria (a current South Australian building work contractor licence and public liability insurance) when we added them to our referral list. It isn’t a guarantee or endorsement of their work, advice, price, availability, conduct or financial position. Licences and insurance can lapse or change. Before you sign anything, check the carpenter’s licence on the Consumer and Business Services website and ask for a current certificate of insurance.
We don’t guarantee that a carpenter will contact you, quote, or be available in your area, and we may decline to refer any enquiry.
Your contract is with the carpenter
Any quote, price, deposit, contract, variation, warranty, council approval and building work is between you and the carpenter. We aren’t a party to any agreement between you and a carpenter and we don’t supervise their work.
The statutory warranties under the Building Work Contractors Act 1995 (SA), the guarantees under the Australian Consumer Law and any other rights relating to the work are given by the carpenter, not by us. Any complaint or dispute about a carpenter’s quote, work, products or conduct is between you and that carpenter.
Fees
We don’t charge homeowners for referrals. Carpenters or other businesses may pay us a fee or give us another benefit for referrals or advertising.
Information, prices and guides
Our guides, articles, prices, cost ranges and timeframes are general information and estimates only. They aren’t professional building, engineering, planning, legal or financial advice, and they aren’t a quote. The actual price is set by the carpenter in their written quote. Prices, fees and rules change, and we don’t guarantee that information on the website is accurate, complete or up to date. Check current requirements with PlanSA, your council, your carpenter or a qualified professional before you rely on them.
Links and other businesses’ content
The website links to websites run by others, and some articles include comments from, or information about, other businesses. Those businesses are responsible for their own content, products and services. We don’t control their websites, and a link or mention doesn’t mean we endorse them.
Using the website
The information you give us must be accurate. It must be yours to share, or shared with the permission of the person it’s about, and you must be entitled to ask for quotes for the property. You must not submit false or spam enquiries, scrape or copy the website’s content, try to access our systems without permission, or interfere with how the website works.
Your consumer rights and our liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, or any other law, that can’t lawfully be excluded. Subject to that, and to the maximum extent permitted by law:
- we provide the website and the service “as is” and “as available”, without any warranty, and don’t guarantee they will be uninterrupted, secure or error-free
- we aren’t liable for any loss, damage, injury, delay or cost arising from any quote, work, advice, product or service provided by a carpenter or other third party, or from your dealings with them
- we aren’t liable for any loss arising from your reliance on information on the website
- we aren’t liable for any indirect or consequential loss, or any loss of profit, revenue, savings or opportunity
- our total liability to you in connection with the website and the service is limited to $100.
Where our liability for a breach of a guarantee can’t be excluded but can be limited, it is limited to supplying the service again or paying the cost of having it supplied again.
If you misuse the website
You’re responsible for any loss, cost or claim we incur because you gave us false information, used the website in breach of these terms, or infringed someone else’s rights, except to the extent that we caused or contributed to it.
Intellectual property
The content on this website, including text, graphics and logos, belongs to Searchology or its licensors. You may view and print it for your own personal use, but you may not copy, republish or reproduce it without our written permission.
Privacy
Our Privacy Policy explains how we collect, use and share your personal information, and forms part of these terms.
Changes to these terms
We may update these terms by publishing a new version on this page. The version on this page when you use the website or submit an enquiry applies.
General
If any part of these terms is invalid or unenforceable, it is read down or severed to the extent necessary, and the rest of the terms continue to apply. If we don’t enforce a right, that isn’t a waiver of it. These terms, together with our Privacy Policy, are the entire agreement between you and us about the website and the service.
Governing law
These terms are governed by the laws of South Australia. You and we submit to the non-exclusive jurisdiction of the courts of South Australia.
